Deadline for NZ National Phase Entry

The deadline for national phase entry into New Zealand is 31 months from the earliest priority date (irrespective of whether International Preliminary Examination has been requested).

Examination

After filing, Examination is automatic (typically quite soon after filing), resulting either in an Examination Report or a Notice of Acceptance. If an Examination report issues, there is a period of 15 months (extendible by up to three months) to gain acceptance. Divisional applications must be filed before acceptance.

An opposition can be filed by any person who has real and substantial interest during a three month period, extendible by one month, from the acceptance publication date in the IPONZ Journal. If no opposition is filed, the Deed of Letters Patent will issue.

Renewals

A patent has a 20 years term provided that renewal fees are paid which are due in the 4th, 7th, 10th and 13th years of the patent (calculated from the filing date of the complete specification). Failure to pay will result in the patent being removed from the Register of Patents six months after the due date.
